This Customer Agreement (this "Agreement"), entered into today (the "Effective Date"), sets forth the arrangement between you ("Customer") and Luna Travel Collective, a North Carolina limited liability company (the "Trip Hosts"), where Trip Hosts agrees to provide travel planning and other related services for Customer under the terms and conditions set forth in this agreement.
1 - Your Booking is A Contract
When the non-refundable deposit is made to secure the spot on the trip Customer will check that they agree to the terms and conditions laid out here. This will constitute a legally binding contract between Customer and Luna Travel Collective LLC..
2 - Deposit
To confirm your booking on the trip,, Customer will pay Luna Travel Collective LLC a non-refundable, non-transferable deposit in the sum of the total amount due as billed in deposit invoice.
3- Payments
The balance of money due shall be paid by the Customer to Luna Travel Collective LLC in 2 equal payments, billed separately. The payment due dates are listed on the trip sales page and are made clear prior to deposit. Invoices will be sent a month prior to the payments are due. If Customer books after the first payment due date, the first payment will be due within 30 days of booking. If Customer books within 30 days of the final payment, the payments must be made in full within 30 days of booking.
Trip Hosts will not hold the room for Customers until the deposit is paid. The payment of the deposit secures their room of choice.
If the payments are not received by the due dates, Trip Hosts reserve the right to cancel the reservation and retain the deposit.
4- Cancellation
Upon event of the Customer canceling their reservation, the deposit and payments are non refundable and non transferable. The Trip Hosts highly advise the Customer obtain trip insurance.
Upon event of Trip Host canceling the trip, all monies paid (deposit, payments) will be refunded within 30 days of the cancellation.
4- Please refer to the trip details on the sales page for exactly what is included in the scope of this trip.
5 -Not Included
Customer is responsible for booking and paying for flights to and from the trip. Flights are NOT included in the payments made to Trip Hosts.
Customer is responsible for obtaining a valid passport and any necessary travel documents.
Travel insurance is not included. Trip Hosts highly recommend the Customer purchase travel insurance.
Optional Activities as detailed on the trip sales page.
Tips for the service staff are not included. Customers are encouraged to tip their car drivers, boat captains and other misc. staff as applicable during the week.
6 - Itinerary
The itinerary listed for the trip is a general plan for the week. Trip Hosts reserve the right to change the itinerary without notice.
7- Terms of Conduct
The Customer shall not use the property for any offensive, noisy, dangerous, illegal, entertainment, immoral or improper purposes. The customer shall not do anything which may be a nuisance or annoyance to Trip Hosts, and its guests, staff or owners.
The Customer shall keep all the home and promperty fixtures, furniture and effects in a clean and good condition and shall replace any articles which are destroyed or missing with articles of a similar kind and of equal value.
Trip Hosts reserve the right at its sole discretion to terminate use of the property or any of its facilities by the Customer in the event of any breach of these terms and conditions. The Customer will be required to vacate the property and Trip Hosts shall not refund payment or accept any consequential liability damages or loss.
8- Misc.
Trip Hosts reserve the right to offer discretionary discounts and this does not affect the status of any guests who have paid the full price and no discount will then become due to them.
All Customers must be 18 years of age or older and agree to be entirely financially responsible for all charges and other fees arising from booking a trip.
It is the Customer's responsibility to ensure that he/she has all the relevant travel documentation and arrives at the airport or train station on time to board their mode of transportation. Trip Hosts can accept no responsibility for delay or cancellation of any flights, train, buses or other forms of transport.
Trip Hosts reserve the right to alter any excursions or activities due to unforeseen circumstances, such as, but not limited to, inclement weather.
The Customer must comply fully with all and any health and safety regulations introduced by Trip Hosts. The Customer must ensure that he/she/they are medically and physically fit and able to use our facilities and participate in activities. Customers who have injuries or illnesses are advised to seek doctors' advice if practicing yoga. Trip Hosts are not liable for any injuries to the Customer in his/her/their use of our facilities or participation in activities. A Customer must always stop and rest if he/she/they are feeling any pain or illness and inform the Trip Host.
Trip Hosts cannot accept any responsibility for loss or damage of personal possessions or valuables of the customer.
In the event of a Customer having any complaint then he/she/they will not discuss this with any third party and shall notify Trip Hosts as soon as possible.
9 - Travel Documents
Customers must have a valid passport. Customer passport must be valid for at least 6 months beyond the duration of the event. It is the Customer responsibility to ensure that he/she/they have a valid passport and all valid travel documentation for this trip. Trip Hosts are not liable for and Customers being refused entry to the country due to incorrect or invalid travel documents.
Trip Hosts strongly recommend that all Customers have adequate travel, cancellation and medical insurance for the duration of the trip. We strongly recommend the purchase of "Cancel for Any Reason" (CFAR) insurance where available.
10 - Photos and Marketing
Customer grants the Trip Hosts the right to use photos and videos for marketing and promotional purposes (including, without limitation, on our website, on social media platforms) on a royalty-free basis, throughout the world and in perpetuity. With respect to any still photos and/or video footage from the week which were shot by the Customer and posted on any social media platform, Customer irrevocably grants Trip Hosts the right to re-post the photos and/or video footage on social media platforms on a royalty-free basis, throughout the world and in perpetuity. We will use good faith efforts to credit you as the source of any photos or footage that is reposted; but our failure to do so will not be a breach of these Terms and Conditions or invalidate the foregoing grant of rights. If you notify us of our failure to credit you, we will remedy that failure as promptly as practicable, in a reasonable manner (which may include the addition of credit, or the take-down of the applicable photo or footage), following receipt of Customer notice.
11 - Assumption of Risk
Trip Hosts is dedicated to providing a safe environment for all Customers who participate in the trip. However, you must take responsibility for your own behavior and safety. Furthermore, you understand and assume the risks and hazards inherent in travel. These risks and hazards may include, without limitation, delays, illness, injury, death, or other unanticipated happenings, and may be caused by force majeure circumstances, the negligence of Trip Hosts or other persons (including third party operators), the intentional and/or criminal conduct of others or other circumstances. It is Customer responsibility to acquaint self with all available and relevant travel information for your destination and the nature of your itinerary. Customer acknowledges and agrees that he/she/their decision to travel is made after having considered this information and expressly assumes the personal risks involved with such travel.
12 - Waiver of Liability and Release
Trip Hosts are not liable for any failures beyond its control. This covers natural disasters, pandemics, epidemics, war, 'act of God', closure of airports, civil strife, accidents or failure to perform by third parties, including suppliers and subcontractors.
Trip Hosts accept no liability for loss, damage, injury or illnesses which may be received during the Customers stay or traveling to and from the trip.
13 - Privacy Policy & Data Protection
Any personal information that Trip Hosts collect about Customer may be used for purposes associated with the operation of this trip or to send you marketing materials in relation to other future trips. You may unsubscribe at any time.
Trip Hosts will collect the name and telephone number of any emergency contact for Customer prior to the trip. Trip Hosts will use this information and contact this person only for emergency reasons. Trip Hosts may disclose this person's name and telephone number to third parties such as villa managers, staff or medical professionals if needed in an emergency. By giving us this information, you consent to this disclosure.
You will be encourage to join a Whatsapp group in order to communicate with everyone in the group. You agree to have your mobile number shared with other participants in the group as well as the Trip Hosts. We will not share your contact information with any third-party agencies for marketing solicitation purposes.
14 - Complaints, Arbitration and Jurisdiction
In the unlikely event that Customer has a complaint during or after the trip, Customer must bring it to the Trip Hosts attention immediately. If Customer complaint is not resolved, then Customer must repeat his/her/their complaint in writing within 7 days of the end of the event by emailing hello@thewrenprojecttravel.com. No complaint will be accepted outside of this time frame thus deeming Customer fully satisfied with all aspects of the trip and services Trip Hosts provided to you. Trip Hosts will acknowledge any correspondence within 7 days and endeavor to deal with the complaint as quickly as possible. Customer must provide any relevant information to enable us to fully investigate the complaint. Complaints which do not involve death, personal injury or illness and which are not made in accordance with this procedure, Trip Hosts will be unable to accept liability.
You agree that any dispute related to your booking, the terms & conditions, the agreement or any other issues to related to the trip (including any claim Customer may wish to assert relating to or arising out of the event) shall be referred to confidential and binding arbitration in the state of North Carolina, by arbitrator (s) and pursuant to rules of arbitration subject to the mutual agreement of the parties. If the parties cannot agree on the arbitrator (s) and/or the rules of arbitration, arbitration may be compelled by petition to any court of competent jurisdiction in North Carolina. Any arbitration award shall be rendered in writing and may be entered and shall be fully enforceable as a judgment in any court of competent jurisdiction. The parties expressly waive their right to trial, including trial by jury. Each party shall bear its own lawyers fees and costs.
This agreement shall be construed in accordance with the laws of North Carolina and New Hanover County, North Carolina shall have exclusive jurisdiction to deal with any disputes arising between Customer and Trip Hosts.
15 - Changes to Terms and Conditions
This agreement supersedes any agreements, either oral or written, between the parties hereto, and contains all the covenants and agreements between the parties hereto. Any modifications of this agreement will be effective only if agreed in writing by Trip Hosts. This agreement is executed in North Carolina on the day and year of Client's book.
